TOYOTA MATERIAL HANDLING - Solutions for Every Pallet

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via mail only.
2. Entry is free and open to residents of Australia aged 16 years or older who purchase a Toyota Huski Skid Steer Loader product (model number 4SDK4, 4SDK5, 4SDK8 or 4SDK10) from a participating retail outlet in Australia during the promotional period and who hold the appropriate statutory permits to operate the equipment purchased. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to purchase the Toyota Huski Skid Steer Loader product and enter the promotion and provide personal information about themselves. All entries of entrants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. The Conditions of Entry will bind the entrants and any parent or legal guardian who gives their consent (for entrants aged 18 years and under). Employees (and their immediate families) of the Promoter, participating outlets, wholesalers, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
3. To enter the promotion, eligible entrants must purchase a Toyota Huski Skid Steer Loader product (model number 4SDK4, 4SDK5, 4SDK8 or 4SDK10) from a participating retail outlet in Australia during the promotional period. Eligible entrants must then, during the promotional period, obtain and complete in full in the manner required an entry form provided in store and post the completed entry form in a stamped envelope to Toyota Material Handling Australia Pty Limited, 8 Secombe Place Moorebank NSW 2170. In order to fully complete their entry, eligible entrants will be required to provide their full name, residential address, business name and activity, telephone number, current and valid email address and the type and serial number of the Toyota Huski product purchased.
4. Only one entry form will be provided for each eligible purchase transaction. Entry forms will be issued by staff at the time of purchase. Entry forms will not be available through any other means. The entry form must be an original and photocopies or images of entry forms will not be accepted. Entries received will be considered final by the Promoter. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the promotional period. The Promoter accepts no responsibility for late, lost or misdirected entries.
5. Multiple entries will be accepted but each entry must contain a separate entry form and must be based on a separate eligible purchase.
6. Promotion commences at 7:00am (AEDT) on 1/3/2008 and closes at 6:00pm (AEST) on 30/9/2008 and will be run over 7 promotional months as stated below in Condition 7. The start, close and draw dates and times (AEDT/AEST as applicable) for each promotional month are as stated below in Condition 7. Each draw will take place at 3:00pm (AEST) at Toyota Material Handling Australia Pty Limited, 8 Secombe Place Moorebank NSW 2170. All winners will be notified by telephone and mail and their names and localities will be published on the Promoter’s website by 5:00pm the day following the draw and in The Australian on the following dates: Draw 1: 21/4/2008; Draw 2: 21/5/2008; Draw 3: 20/6/2008; Draw 4: 21/7/2008; Draw 5: 21/8/2008; Draw 6: 19/9/2008; Draw 7: 21/10/2008. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.

8. Entries for a given promotional month that are not drawn as the winning entry for that promotional month’s draw are eligible for subsequent promotional month draws.
9. Each eligible entrant must retain and may be required to present proof of purchase in order to claim a prize. Entrants may be requested to provide to the Promoter proof of purchase for all entries made. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes the original store receipt for each purchase transaction.
10. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each winner’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the winners in entering the promotion (including confirming consent of a winner’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where a winner is under 18 years of age) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
11. For each promotional month draw, the first five (5) valid entries randomly drawn from all eligible entries received will each win one (1) signed framed Casey Stoner Poster, each prize valued at up to $950.00 (Recommended retail Price including GST).
12. Total maximum prize pool value is up to $33,250.00 (Recommended Retail Price including GST). Prizes are not transferable or exchangeable and cannot be taken as cash. Any unused portion of a prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
13. The Promoter may conduct such further draws as are necessary at the same time and place as the original draw on 8/1/2009 in order to distribute any prizes unclaimed by that date subject to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA) or other State or Territory legislation. All winners in any unclaimed prize draw will be notified by telephone and mail and their names and localities will be published on the Promoter’s website on 12/1/2009 and in The Australian on 15/1/2009.
14. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agents associated with this promotion take no responsibility for prizes damaged or lost in transit.
15. If any prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to State or Territory legislation.
16. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
17. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
19. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
